1. Nature of the Service
newOS is an internet-based coordination and network access service. It enables users to create, manage, and interact with software agents (“Sims” or “agents”) within user-defined environments (“Spaces”) and to connect with blockchains and third-party services via open protocols. The Service provides identity, routing, signaling, and verification rails between users, agents, and protocols.
newOS does not develop or operate foundation AI models. Any interaction with models occurs via third parties or user-supplied components; the Company offers the interoperability layer that coordinates them.
2. Acceptance of Terms
By creating an account, connecting a wallet, or using the Service, you agree to these Terms and to any policies referenced herein. If you do not agree, do not use the Service.
3. Eligibility
You must be at least 18 years old and have legal capacity to enter into this agreement. You are responsible for compliance with the laws of your jurisdiction.
4. Accounts, Wallets, and Access Credentials
You may access the Service via account credentials and/or cryptographic identifiers (e.g., wallets, DIDs). You are responsible for safeguarding your credentials and devices. Actions taken with your credentials are deemed yours unless you notify the Company without undue delay of suspected compromise.
5. Fees and Billing
Access may require subscription or usage fees disclosed at purchase. All fees are non-refundable except where required by law. On-chain actions may incur network fees not controlled by the Company and are non-refundable. You are responsible for applicable taxes.
6. Third-Party Systems and Protocols
The Service interfaces with independent third-party agents, APIs, models, smart contracts, chains, and tools. Their availability, performance, and outputs are outside the Company’s control and may be subject to separate terms and privacy notices. You assume all risks from third-party systems, including downtime, bugs, model errors, smart-contract risk, fee volatility, and the permanence of blockchain records.
7. User Content and Conduct
You are solely responsible for the data, prompts, configurations, endpoints, and signals (“User Content”) you provide and for ensuring you have necessary rights and lawful bases. Prohibited uses include: unlawful content or activity; IP infringement; harmful code; exploitation of minors; doxxing; spam; scraping not permitted by law; attempts to bypass rate limits or security; and any use in violation of sanctions, export controls, or financial-crime laws. The Company may suspend or restrict access for violations.
8. Intellectual Property
The Service (software, UI, documentation, protocol implementations, and marks) is owned by the Company or its licensors and protected by law. You retain your rights in User Content, subject to a non-exclusive, worldwide license for the Company to host, route, transmit, display, and process it solely to operate, secure, and improve the Service, including technical copies/transforms necessary for interoperability.
9. No Professional Advice; Output Caution
Outputs from agents or protocols may be inaccurate or incomplete. The Service does not provide legal, financial, medical, or other professional advice. Independently verify critical information.
10. Service Changes and Availability
The Company may modify or discontinue features, impose or change limits, and perform maintenance. Where reasonably practicable, material adverse changes will be announced.
11. Beta/Experimental and Protocol Features
Certain features may be labeled beta or experimental and are provided “as is” with heightened risk. Do not rely on such features for mission-critical use.
12. Security
The Company implements reasonable technical and organizational measures appropriate to its role as a coordination/network service. No system is perfectly secure; you are responsible for endpoint, key, and wallet security.
13. Compliance; AML/Sanctions
The Company may restrict or terminate access if required by law, sanctions, or law-enforcement requests, or if there is reasonable suspicion of prohibited activity.
14. Warranties and Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE COMPANY DOES NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION OR THE ACCURACY OF ANY OUTPUTS FROM THIRD-PARTY AGENTS OR PROTOCOLS.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR REVENUE, ARISING OUT OF OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. THE COMPANY’S AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO THE COMPANY FOR THE SERVICE IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY OR (B) EUR 100.
16. Indemnity
You will indemnify and hold the Company harmless from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from (a) your misuse of the Service, (b) your User Content, or (c) your violation of these Terms or applicable law.
17. Term; Suspension; Termination
You may stop using the Service at any time. The Company may suspend or terminate access for any violation of these Terms, legal requirement, or risk to the Service. Sections intended to survive (including IP, fees, disclaimers, limitations, indemnity, and governing law) will survive termination.
18. Governing Law and Venue
These Terms are governed by the laws of the Czech Republic (excluding conflict-of-laws rules). Courts in Prague have exclusive jurisdiction, unless mandatory consumer protection rules provide otherwise.
19. Changes to Terms
We may update these Terms from time to time. Material changes will be notified via the Service or by email where available. Continued use after the effective date constitutes acceptance.

This Privacy Policy explains how we process personal data when operating newOS as a coordination/network service. We act primarily as an independent data controller for account, billing, security, and platform telemetry. For agent/model interactions routed to third parties, we typically act as a conduit/processor for minimal routing metadata; the third party (or you) is the controller for model-side processing.
2. Categories of Data We Process
Account & Identity: email, username, wallet address/DID, country, support communications.
Technical & Telemetry: IP address, device/browser data, timestamps, logs, performance metrics, crash reports, security events, coarse geolocation from IP.
Service Metadata: agent/Space identifiers, routing events (e.g., “prompt sent to endpoint X at time Y”), payment status and receipts, usage metrics (counts, durations, limits).
Content Transit: prompts, documents, outputs, files, and signals you submit for coordination. We do not use your private content to train our models. Transit content may be temporarily processed/cached for delivery, abuse detection, quality-of-service, and troubleshooting.
Cookies/Local Storage: strictly necessary cookies for authentication, session continuity, and security; analytics cookies only with consent.
3. Purposes and Legal Bases (GDPR)
Provide and improve the Service; ensure availability and performance (Art. 6(1)(b) contract; Art. 6(1)(f) legitimate interests).
Security, fraud/abuse prevention, rate-limiting, incident response (Art. 6(1)(f); and where required, Art. 6(1)(c) legal obligation).
Billing/payments/accounting (Art. 6(1)(b), (c)).
Service communications and support (Art. 6(1)(b), (f)).
Optional analytics and product research (Art. 6(1)(a) consent; you can withdraw consent at any time).
4. Disclosures and Recipients
Infrastructure and security providers (hosting, CDNs, monitoring, email, analytics with consent).
Payment processors (we do not store full payment card details).
Third-party agents/APIs/blockchains you choose to connect—shared only as necessary to perform your requested coordination; such parties are independent and have their own policies.
Legal recipients where required by law or to protect rights, security, or property.
5. International Transfers
We may transfer data outside the EU/EEA. Where we do, we rely on approved safeguards (e.g., adequacy decisions or Standard Contractual Clauses) and implement supplementary measures where necessary.
6. Retention
Account & billing records: retained for the life of your account and for statutory retention periods thereafter.
Logs and telemetry: typically 30–180 days unless needed for security investigations or required by law.
Transit content: retained only as long as needed to route, deliver, troubleshoot, or when you opt to store it in a Space. Deletions generally remove items from active systems within a reasonable period, subject to backups and legal holds.
7. Your Rights (GDPR/EEA)
You may request access, rectification, erasure, restriction, portability, and objection, and you may withdraw consent where processing relies on consent. You can lodge a complaint with your local supervisory authority or with the Czech Office for Personal Data Protection (ÚOOÚ). To exercise rights, email hello@new.foundation.
8. Security
We employ reasonable technical and organizational measures appropriate to our role. You remain responsible for endpoint security, wallet/key custody, and any sharing of content or credentials.
9. Children
The Service is not intended for individuals under 18. We do not knowingly process children’s data.
10. Cookies and Similar Technologies
Necessary cookies support authentication, security, and core functionality.
Analytics/measurement cookies operate only with your consent. Manage preferences in product settings or your browser.
11. Third-Party Services and Protocols
When you connect third-party agent endpoints, APIs, or blockchains, your data is processed subject to those parties’ terms and privacy notices. We are not responsible for their practices.
12. Changes to This Policy

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR REVENUE, ARISING OUT OF OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. THE COMPANY’S AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO THE COMPANY FOR THE SERVICE IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY OR (B) EUR 100.
16. Indemnity
You will indemnify and hold the Company harmless from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from (a) your misuse of the Service, (b) your User Content, or (c) your violation of these Terms or applicable law.
17. Term; Suspension; Termination
You may stop using the Service at any time. The Company may suspend or terminate access for any violation of these Terms, legal requirement, or risk to the Service. Sections intended to survive (including IP, fees, disclaimers, limitations, indemnity, and governing law) will survive termination.
18. Governing Law and Venue
These Terms are governed by the laws of the Czech Republic (excluding conflict-of-laws rules). Courts in Prague have exclusive jurisdiction, unless mandatory consumer protection rules provide otherwise.
19. Changes to Terms
We may update these Terms from time to time. Material changes will be notified via the Service or by email where available. Continued use after the effective date constitutes acceptance.

1. Scope and Roles
This Privacy Policy explains how we process personal data when operating newOS as a coordination/network service. We act primarily as an independent data controller for account, billing, security, and platform telemetry. For agent/model interactions routed to third parties, we typically act as a conduit/processor for minimal routing metadata; the third party (or you) is the controller for model-side processing.
2. Categories of Data We Process
Account & Identity: email, username, wallet address/DID, country, support communications.
Technical & Telemetry: IP address, device/browser data, timestamps, logs, performance metrics, crash reports, security events, coarse geolocation from IP.
Service Metadata: agent/Space identifiers, routing events (e.g., “prompt sent to endpoint X at time Y”), payment status and receipts, usage metrics (counts, durations, limits).
Content Transit: prompts, documents, outputs, files, and signals you submit for coordination. We do not use your private content to train our models. Transit content may be temporarily processed/cached for delivery, abuse detection, quality-of-service, and troubleshooting.
Cookies/Local Storage: strictly necessary cookies for authentication, session continuity, and security; analytics cookies only with consent.
3. Purposes and Legal Bases (GDPR)
Provide and improve the Service; ensure availability and performance (Art. 6(1)(b) contract; Art. 6(1)(f) legitimate interests).
Security, fraud/abuse prevention, rate-limiting, incident response (Art. 6(1)(f); and where required, Art. 6(1)(c) legal obligation).
Billing/payments/accounting (Art. 6(1)(b), (c)).
Service communications and support (Art. 6(1)(b), (f)).
Optional analytics and product research (Art. 6(1)(a) consent; you can withdraw consent at any time).
4. Disclosures and Recipients
Infrastructure and security providers (hosting, CDNs, monitoring, email, analytics with consent).
Payment processors (we do not store full payment card details).
Third-party agents/APIs/blockchains you choose to connect—shared only as necessary to perform your requested coordination; such parties are independent and have their own policies.
Legal recipients where required by law or to protect rights, security, or property.
5. International Transfers
We may transfer data outside the EU/EEA. Where we do, we rely on approved safeguards (e.g., adequacy decisions or Standard Contractual Clauses) and implement supplementary measures where necessary.
6. Retention
Account & billing records: retained for the life of your account and for statutory retention periods thereafter.
Logs and telemetry: typically 30–180 days unless needed for security investigations or required by law.
Transit content: retained only as long as needed to route, deliver, troubleshoot, or when you opt to store it in a Space. Deletions generally remove items from active systems within a reasonable period, subject to backups and legal holds.
7. Your Rights (GDPR/EEA)
You may request access, rectification, erasure, restriction, portability, and objection, and you may withdraw consent where processing relies on consent. You can lodge a complaint with your local supervisory authority or with the Czech Office for Personal Data Protection (ÚOOÚ). To exercise rights, email hello@new.foundation.
8. Security
We employ reasonable technical and organizational measures appropriate to our role. You remain responsible for endpoint security, wallet/key custody, and any sharing of content or credentials.
9. Children
The Service is not intended for individuals under 18. We do not knowingly process children’s data.
10. Cookies and Similar Technologies
Necessary cookies support authentication, security, and core functionality.
Analytics/measurement cookies operate only with your consent. Manage preferences in product settings or your browser.
11. Third-Party Services and Protocols
When you connect third-party agent endpoints, APIs, or blockchains, your data is processed subject to those parties’ terms and privacy notices. We are not responsible for their practices.
